1. What is the difference between leasehold and freehold?
Leasehold refers to renting a property out directly from a landlord or a leaseholder for a certain period of time, typically between 25 and 30 years, with the option to renew the lease for an additional 25 or 30 years. A leasehold property may be owned by a foreigner without a visa.
The highest land title available in Indonesia is freehold, which gives the owner a permanent ownership on the property. However, only Indonesian citizens or foreign corporations may possess freehold titles, in this case, the HGB (Hak Guna Bangunan) title.
2. Can I lease a villa legally as a foreigner?
You can, indeed. Even for leasehold property, Bali Treasure Properties will always guide you to a legal real estate transaction.
Every document that is required to protect your rights as a landowner and a leaseholder can be legalized with the assistance of our trustworthy notary.
3. Do I need to obtain a certain visa to buy a leasehold property?
You don't have to. If you want to purchase a leasehold property, you are not obliged to have a particular visa.
All you need to do is get a copy of your passport and the information you want to include in the leasehold agreement deed about any appointed heirs.
A working visa is required if you want to work and earn money in this country, which is a distinct situation.
4. What happens if my lease expires?
At the end of the lease period, the land and any permanent building structures on it will revert to the landowner's legal ownership. You can however keep all the inventory and all of the moveable items in the villa.
However, in most instances, you will have the option to extend your lease period before it expires. Ideally, you will want to extend your lease period before you get below the 20 year mark.
5. What is the next step after we find a deal with the seller?
Bali Treasure Properties will make sure you are going through the right direction during the process of finding your new home. Thus, we will always guide you on every next step of closing the deal with the property owner.
The next stage is to get ready to sign the Sale & Purchase Agreement, which terms have been approved by both parties and are beneficial to both. Following the execution of such a contract, the buyer may already submit a deposit into the notary's escrow account to initiate the due diligence procedure.
When the outcome of the due diligence is declared to be clear, the seller will get the deposit payment, and the buyer can securely proceed to make the balance payment, it will be time to arrange for the lease agreement deed to be signed in front of a public notary.
6. Should I send a construction surveyor before signing anything?
You can but you don’t have to. Please contact us if you need someone reliable to evaluate the building structure.
7. We have secured a deal with the seller. Can I later extend the lease up to 99 years lease with the landowner?
Yes, you can. An initial 25-year lease on a leasehold property can only be renewed for an additional 70 years.
8. What fees do I have to pay when purchasing a property?
You only pay the closing notary fee as the buyer of a leasehold property, which is usually 1% of the transaction volume. Our agency fees and any lease income tax are to be paid by the seller.
As the new leasehold owner, you will be responsible for paying all ongoing monthly expenses related to the property after property handover.
9. Should I appoint a lawyer or notary, or both of them, for the due diligence? Do you have a recommendation?
As a buyer, you have the authority to assign any Indonesian public notary to carry out the due diligence on the property you are buying.

10. What are they checking on due diligence?
The due diligence check will include a review of the land certificate to ensure :
- That the property is not subject to a mortgage
- A review of the land and building taxes, a review of the building permit
- A review of the zone, a review of the road access
- A notarial verification of the validity and applicability of all related legal documents
11. How long does it take to run a due diligence?
Typically, it takes 14 to 30 working days to complete the due diligence procedure. The complexity of the property's history will determine this.
It will also speed up the process if the documents are complete when they are first checked.
12. How long does it take to get my land certificate (SHM/SHGB) after we sign the AJB?
After signing the AJB, it typically takes 14 working days to complete and issue the land certificate in your name.
13. How many names can I put on the leasehold agreement?
The leasehold agreement can have as many names as you like, but this must be agreed upon by the property owner.
14. Should I put my name or my company on the leasehold agreement?
If you want to name the lease agreement after your business, there is no downside to doing so.
Therefore, you can choose to have your name or the name of your business appear on the lease agreement deed.
15. In buying a freehold, I don’t have a company nor an Indonesian spouse. Can I use my local friend’s name as my nominee?
Using any name as a nominee to purchase a freehold property in Indonesia is no longer advised. In truth, you can safeguard your ownership interests in the property with a set of nominee agreements, but we can't promise that you'll prevail in court if something goes wrong.
Creating a limited liability company in Indonesia and obtaining the Hak Guna Bangunan certificate in your company's name is the safest approach to purchase a freehold property.
16. I can’t attend the notarial signing, what should I do?
By presenting a set of signed power of attorney and submitting it to the public notary at the time of signing, you must designate someone to sign the notarial deed on your behalf.
17. Can I transfer the lease rights to my family member?
Absolutely, you can. Simply make sure that the heir clause on the leasing agreement deed includes your family member's name.
18. Do I have the right to sell the lease of the property I buy?
Yes, as long as the lease term is still in effect, you have the entire right to sell the lease of the property.
Upon transferring ownership of the leased property to a new leaseholder, the landowner shall sign a letter of notification to the landowner.
